What are damages?

In a successful personal injury case, the party at fault will be required to pay damages, or financial compensation, to the injured individual. There are different types of damages, and they all fall into one of two different categories:

  • Compensatory (Actual) Damages: These are damages awarded to the injured party in order to compensate for his or her medical bills, lost wages, damaged property, and/or pain and suffering.
  • Punitive Damages: These are damages paid to the injured individual not as compensation for acquired financial burden, but rather to reprimand and deter the party at fault from taking such careless actions in the future.
